I had to go looking for this old conversation, but it was totally appropriate the story I'm about to tell:

Tsaiko: It's drama that I don't have to be involved in to appreciate.

This was the drama that was going on where I work. I got to hear it all because I sat near the guy.

So one of my co-workers, will call him Bob, bought a house last year. The house was a short-sale and he paid $300,000 cash for it. Everything was fine and dandy until today, when he's trying to get some paperwork taken care in order to file his taxes. He's trying to get something transferred over to his name. That's when he finds out that he can't get the paperwork transferred over because there is a lien on the property because it's been foreclosed on.

"What?" This was said in a voice of total shock. This is also about the time I started listening. "What name is it under? Bob Smith!? That's my name. What do you mean my name is listed on the foreclosure papers? I don't have a mortgage on the property. I own it. I paid in cash. I have the deed to prove it."

Over a series of phone calls throughout the day, I hear the entire story. Bank of America was one of the original holders of the mortgage. Bob bought it from them last May. Well no one from the division that brokered the sale informed the division that handles foreclosures. So they showed that no payments were being made on the mortgage and started formal foreclosure proceedings. To do that they looked at who was listed as the documents as the owner. That would be Bob Smith. Never mind that Bob wasn't the name on the mortgage. BoA can't let pesky little details like that stop them.

They foreclosed on the property last September. Didn't send any notices. Didn't send let Bob know. It was only a stroke of luck that Bob found out before he was locked out, his utilities disconnected, or all his stuff sold/destroyed. After all, BoA hasdone it to others.

I think the best part was when Bob called someone to try and sort this out and had the following conversation. "An error? Misplacing a $50 check is an error. This is $300,000 of my money." Wow.

I have to admit, I cannot wait to see what further developments occur. I hope Bob sues the crap out of them.

I know I'm never going to get a mortgage with BoA.
